By accessing or using Efecto ("the Service"), available at efecto.app, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Efecto is an AI-native design tool that enables humans and AI agents to create designs together. The Service includes a browser-based design studio, visual effects tools, MCP integration for AI agents, cloud storage, and related features.

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes.

4. User Content

You retain ownership of all content you create using Efecto, including designs, images, and other materials ("User Content"). By using the Service, you grant Efecto a limited license to host, display, and process your User Content solely to provide the Service to you.

You are solely responsible for your User Content. You agree not to upload content that infringes on third-party rights, violates any law, or contains harmful material.

5. AI-Generated Content

Efecto uses AI to assist with design creation. AI-generated content is provided "as is" without warranties of originality or fitness for a particular purpose. You are responsible for reviewing and ensuring AI-generated content is appropriate for your use.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the Service or its infrastructure
Reverse engineer, decompile, or disassemble any part of the Service
Use the Service to generate content that is harmful, abusive, or violates third-party rights
Resell or redistribute the Service without written permission

7. Subscriptions and Payments

Some features require a paid subscription. Prices are listed on our pricing page. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

8. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by Efecto and protected by intellectual property laws. These Terms do not grant you any rights to Efecto's trademarks, logos, or other brand features.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Efecto shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to Efecto in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
